What happens if I miss my last day?

Each notice code has its own count. Missing the last day costs you a right you cannot get back.

  • LT11, day 30: You lose the Collection Due Process hearing, and the IRS can take money from your wages or bank account. Form 12153 must go out by the hearing request deadline printed on your LT11 or Letter 1058, as the Collection Due Process FAQs explain.
  • CP3219A, day 90: The Tax Court cannot take your case, and the IRS assesses the tax. Your petition must be filed before day 90, even while talks with the IRS go on, per the IRS CP3219A page.
  • CP161, day 10: The 10 days the IRS asks for to report a mistake have passed, and interest keeps growing. A licensed tax pro can still compare the notice payments with your records.
